Washington and Nevada Resident Privacy Notice

This Washington and Nevada Resident Privacy Notice (“Privacy Notice”) supplements the Skkbra Privacy Policy and applies only to personal data defined as “consumer health data” that is subject to the Washington State My Health My Data Act (MHMDA) and the Nevada Health Data Privacy Act (NHDPA) (collectively, “U.S. State Health Privacy Laws”).

Categories of Consumer Health Data We Collect

Depending on the context of your interactions with Skkbra and your use of the Jano Petal device and mobile apps, we collect the following categories of Consumer Health Data:

  • Individual health conditions, treatment, diseases, or diagnosis: This includes data derived from the Jano Petal sensors such as Electrocardiogram (ECG) data, heart rate, resting heart rate, heart rate variability, heart rate zones, respiration/breath rate, and body temperature.
  • Bodily functions, vital signs, symptoms, or measurements: This includes Bioelectrical impedance analysis (BIA) data used to determine body composition (e.g., muscle and mid-section fat percentage), metabolic rate, calories burned, and activity intensity.
  • Biometric data: While Skkbra utilizes your device's native biometric security (FaceID/TouchID) for app access, the raw physiological measurements collected by the Petal device (ECG and BIA) may be classified as biometric data under applicable state law; we will obtain your explicit, unbundled consent before collecting and processing this data.
  • Data related to state of mind: This includes daytime stress levels calculated by our algorithms and "mindful minutes" or "state of mind" data pulled from Apple HealthKit.
  • Health-related inferences: This includes automated insights and personalized feedback generated by our algorithms regarding your different heart and body metrics, including readiness or activity scores.

Sources of Consumer Health Data

We collect Consumer Health Data from the following categories of sources:

  • Directly from the Jano Petal Device: Passive collection via ECG, BIA, and IMU sensors.
  • Directly from You: Information you manually log in the Jano mobile application (e.g., profile data, cycle tracking).
  • Third-Party Connected Platforms: Data you authorize Skkbra to pull from platforms such as Apple HealthKit (and in the future, Google Health Connect and Terra).
  • Interaction with our Services: Technical logs generated during device-to-app syncing.

Purposes for Collection and Use of Consumer Health Information

We collect and use Consumer Health Data for the following purposes:

  • To Provide and Maintain Services: Processing raw sensor data to provide health insights, track progress, and power safety features like fall detection.
  • Personalization: Providing tailored health content and recommendations based on your unique physiological baselines.
  • Product Improvement: To train our algorithms and fix software bugs.
  • Research: To generate anonymized or aggregate data for scientific study (including partnerships with academic institutions like George Washington University).

Our Sharing of Consumer Health Data 

We may share the categories of Consumer Health Data described above with the following third parties:

  • Service Providers: Specifically, AI and engineering consultants in India and South Korea who assist in algorithm training and product optimization.
  • Connected Health Ecosystems: If you enable third-party integrations, we share data (such as heart rate and HRV) with Apple HealthKit as directed by you.
  • Research Partners: We share anonymized data with George Washington University and potentially other academic partners for scientific research.
  • Legal & Corporate Requirements: To comply with law enforcement or in the event of a merger or acquisition.

Note: We do not allow third parties to collect your Consumer Health Data over time and across different websites or online services when you use our Services, except for those health platform integrations (e.g., Apple HealthKit) that you explicitly authorize. We strictly prohibit third-party advertising tracking pixels within the logged-in Skkbra mobile application environment.

 Your Privacy Rights

Under Washington and Nevada law, you have specific rights regarding your Consumer Health Data, including the right to access, the right to confirm if we are sharing/selling your data, the right to delete your data, and the right to withdraw consent for processing.

Submitting Requests: You can submit a request to exercise your rights by emailing us at support@skkbra.us. If your request is denied, you may appeal the decision by contacting the Washington State Attorney General (www.atg.wa.gov) or the Nevada State Attorney General (https://ag.nv.gov/Contact/).
